Terms of Use
These Terms of Use govern general use, membership, content and technical services on velvetacare.com (the “Site”), operated by Mina Keshavarz / Velveta Care (“Velveta”).
Rights and obligations relating to sales are separately governed by the Distance Sales Agreement, Pre-information Form, Return and Withdrawal Policy, and Shipping and Delivery Policy.
1. Authority to Use the Site
People without legal capacity or the authority required for a transaction must perform it through their legal representatives.
2. Account and User Information
The user must: - provide accurate and current information, - take reasonable care to protect account/password details, - inform Velveta without delay of suspected unauthorized use
and comply with these obligations.
Losses and unauthorized transactions resulting from the user's own fault in sharing login details with third parties or failing to take reasonable security measures are assessed according to the circumstances and applicable law.
Deleting an account does not mean immediate deletion of records covered by tax, consumer, e-commerce, dispute-related or other statutory retention obligations.
3. Prohibited Uses
The following are prohibited: - compromising the security of the Site or infrastructure, - attempting unauthorized access or data acquisition, - overloading systems with malware or automation, - using another person's identity/account/payment information without permission, - creating fraudulent or manipulative orders, - exploiting coupon/promotion vulnerabilities, - commercially using Site content or Velveta intellectual property without permission, - carrying out unlawful activities.
Where there are reasonable grounds to suspect a security issue, fraud, chargeback, misuse or a legal breach, Velveta may investigate the account/transaction and, to the extent permitted by law, temporarily restrict it or request security verification.
This provision does not remove the consumer's mandatory rights relating to sales.
4. Orders and Technical Errors
Product and price information is kept as current as possible.
If there is an obvious technical error, duplicate transaction, system failure, or suspected unauthorized use or misuse, Velveta may review the order, temporarily suspend dispatch and contact the Buyer.
Whether an order may legally be cancelled, corrected or fulfilled depends on the specific circumstances and mandatory consumer law; this clause does not authorize Velveta to arbitrarily cancel valid consumer contracts.
5. Intellectual Property
Unless stated otherwise, the Velveta brand, logo, original text, product images, designs, graphics, software elements and other Site content belong to Velveta or the relevant rights holder.
Except for personal uses permitted by law, content may not be commercially reproduced, distributed, adapted or used in a way that suggests brand affiliation without written permission.
6. External Links
The Site may link to third-party websites/services. Velveta does not guarantee third-party content or service continuity beyond its control.
Velveta's mandatory responsibilities under KVKK, consumer law and other legislation for service providers it selects remain reserved.
7. Personal Data and Cookies
These Terms do not repeat a separate lengthy privacy policy.

8. Commercial Electronic Messages
Marketing-related commercial electronic messages are sent only where the necessary consent has been obtained.
Transaction notices concerning orders, collection of payments, delivery, returns, account security or legal requirements may not require separate marketing consent to the extent they contain no promotional content.
9. Force Majeure
In extraordinary circumstances beyond the parties' reasonable control, such as natural disasters, war, general infrastructure outages, widespread cyberattacks or public-authority actions, obligations are assessed according to the event's nature and applicable law.
Mandatory consumer rights and the notification/refund duties applicable when performance becomes impossible remain reserved.
10. Changes
Velveta may update these Terms prospectively to meet legal, security and service requirements.
Updates apply to Site use and transactions occurring after publication. Mandatory rights arising from existing transactions cannot be removed retroactively.
11. Electronic Records
Site, membership, security, order and system records may be submitted as evidence within the framework of applicable legislation.
The user's statutory rights to present evidence and raise objections remain reserved.
12. Disputes
For consumer transactions, mandatory rules on the duties and jurisdiction of consumer arbitration committees, mediation and consumer courts remain applicable.
For disputes with non-consumer parties where a valid jurisdiction agreement is permitted under HMK Article 17, a jurisdiction clause separately agreed by the parties may apply.
